Currently, on the MQL5 Market, developers can only sell compiled products (EX5 files). There is no official option to sell source code (MQ5), even in special cases where buyers may want to purchase full ownership or exclusive rights to a trading tool.
I would like to propose adding a controlled and optional mechanism that allows developers to sell source code through an auction-based or negotiated licensing system.
Yes, I fully support this. I currently have source code that I want to sell. It would be great if there was an ad system in addition to being able to send private messages to popular EA sellers. (At least there could be a thread about this on the forum.)
Say me wrong, but I think this is how freelancing works.
Someone asks for a task, code, etc... and a developer gives his price (among other devs), and the one that is chosen by the customer select one.

In freelance, you execute what the client asks you.
There is no possibility of a proposal for sale as source code, your ideas.
You only have the possibility, to put in the code base for free, or to write an article....
On the other hand, as a seller, many times, I have been asked, if I am willing to sell the source code, of an already existing product. And I would have accepted in some cases.
This is an advantage for both the client and me. Because he can already improve something, and be satisfied, not everyone asking me for different changes.

From a legal standpoint, yes, coders can selectively license their codes to individual users which is legally binding.
But from a practical standpoint, consider how such a coder would go about enforcing a license. As we know, MetaTrader is the most popular forex trading platform worldwide. Let's say there's a coder in China who issues a limited license to a user in the United States, for example. After several days, weeks, months, or even years, the code is posted elsewhere online. Assuming that the codes are the same (not modified into something substantially different which constitutes a new work), the first step of enforcement is tracing the chain of custody from the licensee to the wrongdoer--which means that we also have to identify the wrongdoer, by the way. Good luck doing that on the internet.
Second, the coder must figure out where to file a claim. Member-countries of the Hague Convention allow their residents to file a claim at home and follow the Convention's universal service of process rules for defendants in other countries. To be clear, this is an international lawsuit which requires hiring an international attorney at a minimum. If the coder's work isn't demonstrably worth at least 7 digits, it just isn't worth it. Let's assume that Metaquotes' arbitration clause was written into the deal because presumably, it would be. Unless the user in breach of the license has a large mql5.com balance, the remedy available to the coder is basically limited to peanuts. Consider how much a scammer would have on deposit--not much.
Similar facts in other disputes are the reasons that the overwhelming majority of legally valid claims never see a tribunal of any kind. Put simply, the law doesn't exist in a vacuum.
At the end of the day, shared code enters the abyss of the unknown once it is shared. We can only deduce that the mql5.com Market is structured the way that it is for that reason.
I agree that developers should be able to sell their code.
