Refunds on backtest cheating EAs

 
Is it possible to get a refund on an EA and possibly get it banned from the market if it is found to be cheating Backtesting

I think Seer is one such example. All EAs by it's author seem to do the same. 

Also, is there any plan to make it compulsary to have live tests / signals for each EA being sold in the market?
