More to the point of discussion, what are the reasons and conditions why one would pay someone to do their coding for them, and accept the terms that this coder has dictated.

I pointed out that anyone with a truly winning strategy would not accept his terms.
Everyone thinks they have a winning strategy, maybe 0.01% actually do. Most people have not done sufficient testing to actually know how their strategy performs. So what you are saying is that only those with rubbish startegies will accept his terms . . so no harm done.
