For the cracked , the decompilation cannot be proven (law-wise) ?
The unlicensed access is copyright infringement, and decompilation is a DMCA violation even if the license doesn't prohibit decompilation. This is U.S. law, but international treaties are largely the same.
What can be proven is a matter of, well... evidence. The unlawful conduct has to be traced and documented.
Hint: Throw a binding private arbitration clause into your terms. You'll have a lot easier time "proving" an obvious case to a private arbitrator when you're the party that brought the business to the arbitrator--without having to satisfy 100% of a court's procedural and substantive rules. This is the worst kept dirty secret of U.S. businesses.
