I can't use this EA and I want to be refund, how to proceed?
Ask a moderator or contact to Service Desk to know if that possible.
Or tell us which error appears in "Experts" section once you attach the EA maybe it can be solved and make it work again.
may be it was server issue
according to my knowledge, once program is published in market author will not change that
and error was initializing failed,

It is what I was reading from the rules:
"The Buyer shall provide the Seller all information necessary for
reproducing and fixing errors described in paragraph III.5 and III.6. of
these Rules. Claims of general type, such as "It does not work", "The
program is not working properly," etc., shall not be considered".
I think - it is the best way for you to contact with the buyer, besides, please note that it may be any issue other than the issue with the market product (if it works for 2 months but stop working on the 3rd month so ... and same product ... and no one changed anything ... you did nothing ... buyer did nothing because it is same product ...).
You can't demand a refund. But you can require a fix if it's a bug in the EA, which seems well the case :
